Commercial Tenancies
Landlords and Tenants can decide whether to create a Commercial Lease (Business Lease), which is governed by the Landlord and Tenant Act 1954 (LTA 1954), or excluded from it.
Under the LTA 1954, Sections 24 to 28 have prescribed terms and strict rules governing the termination and renewal of Business Tenancy Agreements as well as alterations to the rent for both the Landlord and the Tenant.
Since 2003, it has been possible to contract out of these strict requirements by using Notices, ‘The Landlord’s Warning Notice’ along with the relevant ‘Tenant’s Notice’.
Therefore, the Landlord and Tenant must decide if they wish to contract out of the Landlord and Tenant Act 1954 or not. Type 1 below deals with Commercial Leases and related documents under the LTA 1954. Type 2 deals with Commercial Leases where the Landlord and Tenant wish to contract out of the LTA 1954.

Type 1 - Leases under the Landlord & Tenant Act 1954
Type 2 - Leases outside the Landlord & Tenant Act 1954

- Non LTA 1954 Notice Package: £30.00
Since 2003 it has been possible for the Landlord and Tenant to contract out of the LTA 1954, by the service of a Warning Notice by the Landlord and the Tenant then serving a Notice in response to the Landlord's Notice. This can be either a Simple Declaration (if it is served at least 14 days before the Commercial Lease is signed) or a Statutory Declaration (if the parties wish to sign the Commercial Lease stright away). We provide all three Notices and more information about the procedure for sending and signing them with this package.
Registration of Leases in excess of 7 years
- Lease Registration: £60.00
Leases in excess of 7 years need to be registered with the Land Registry. We will complete all necessary forms for you and liaise with the Land Registry.
